Agreement
By downloading, installing, or using HerCycle ("the app"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the app.
These Terms constitute a legally binding agreement between you and Purple Softworks ("we", "us", "our"), the developer of HerCycle.
The App
HerCycle is a mobile application that helps partners track menstrual cycles, pregnancy milestones, and relationship tasks. It is designed for personal, non-commercial use.
All data you enter into HerCycle is stored locally on your device. We do not operate servers that hold your personal or health information.
Not Medical Advice
HerCycle is not a medical device and does not provide medical advice.
- Cycle predictions are estimates based on historical data you enter. They are not medically accurate predictions and should not be relied upon for contraception, fertility treatment, or any medical decision.
- Pregnancy information provided in the app (baby size, development milestones) is general educational content based on average development and is not specific to your partner's pregnancy.
- The contraction timer feature provides a general timing reference only. It does not replace professional medical assessment. Always contact your healthcare provider when you are unsure whether labour has begun.
- If you or your partner have a medical concern, consult a qualified healthcare professional.
Purchases and Payments
Free tier
HerCycle offers a free tier with core features at no cost. No payment is required to use the free tier.
HerCycle Pro — one-time purchase
Pro features are unlocked via a single one-time payment processed through the App Store (iOS) or Google Play (Android). This is not a subscription. You pay once and retain access to Pro features permanently on that platform.
- Payment — processed entirely by Apple or Google. We do not see or store your payment information.
- Refunds — refund requests are handled by Apple or Google in accordance with their respective policies. We do not process refunds directly. Contact Apple or Google support for refund requests.
- Platform — your purchase is tied to your App Store or Google Play account. It can be restored on any device using the same account via Settings → Restore purchase.
- Price changes — the purchase price may change for new customers. Existing purchasers retain their Pro access regardless of price changes.
Restoring a purchase
If you delete and reinstall the app, use Settings → Restore purchase to recover your Pro access at no charge.
Acceptable Use
You agree not to:
- Use the app for any unlawful purpose.
- Attempt to reverse engineer, decompile, or extract the source code of the app.
- Use the app to monitor another person without their knowledge or consent.
- Interfere with the security or integrity of the app.
- Use automated tools to scrape or extract data from the app.
- Misrepresent your identity or affiliation.
Intellectual Property
All content within HerCycle — including the app design, code, text, graphics, and mission content — is owned by Purple Softworks and protected by intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to use the app for personal, non-commercial purposes on devices you own or control.
You may not copy, reproduce, distribute, or create derivative works from any part of the app without our prior written consent.
Your Content
You retain full ownership of any content you create within the app — journal entries, notes, tasks, and logged data. This content is stored on your device only. We do not access, process, or hold copies of your content on our servers.
Deleting the app permanently deletes all your content. We cannot recover it.
Privacy
Your use of the app is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.
Disclaimer of Warranties
The app is provided "as is" and "as available" without warranties of any kind, express or implied.
We do not warrant that:
- The app will be available at all times or free from errors.
- Cycle or pregnancy predictions will be accurate.
- The app will meet your specific requirements.
To the maximum extent permitted by applicable law, we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by applicable law, Purple Softworks shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages.
- Any loss of data resulting from device loss, damage, or app deletion. We hold no backup of your data.
- Any damages resulting from reliance on cycle predictions or health information in the app.
- Any damages resulting from decisions made based on app content.
Our total liability to you for any claim shall not exceed the amount you paid for the app.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.
Indemnification
You agree to indemnify and hold harmless Purple Softworks and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the app or violation of these Terms.
Third-Party Services
The app integrates with third-party services including Apple App Store, Google Play, RevenueCat, and PostHog. Your use of those services is subject to their respective terms and policies. We are not responsible for the conduct of third-party services.
Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by displaying a notice in the app. Continued use of the app after changes constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Purple Softworks regarding your use of the app.
